1. Coverage and Application Scope
1.1 These General Terms and Conditions (referred to as "GTC") by Bliss By Iman e.U. (referred to as "Seller") govern all agreements between the Seller and a consumer or a trader (referred to as "Client") pertaining to products and/or services showcased in the Seller's online store. The inclusion of the Client's terms is objected to, unless expressly agreed otherwise.
1.2 For the acquisition of vouchers, these GTC apply, unless explicitly stated otherwise.
1.3 In contracts related to voucher delivery, these GTC apply unless otherwise agreed.
1.4 A consumer under these GTC is an individual making a transaction for a purpose not mainly linked to commercial or self-employed activities.
1.5 A trader under these GTC is a natural or legal person or a legally capable partnership, conducting a legal transaction in the course of commercial or independent professional activities.
2. Contractual Agreement
2.1 The product descriptions in the Seller’s online store are not binding offers but serve to submit a binding offer by the Client.
2.2 The Client can submit the offer via the online order form on the Seller's website. By placing selected items and/or services in the virtual cart, proceeding through the order process, and clicking the button to finalize the order, the Client makes a legally binding contract offer for the items and/or services in the shopping cart.
2.3 The Seller may accept the offer within five days by: a) Sending a written order confirmation; in case of discrepancy, the receipt of the order confirmation by the Client is decisive, or; b) Delivering the ordered items to the Client; in case of discrepancy, the receipt of the items by the Client is decisive, or
Requesting payment from the Client after order placement.
If multiple alternatives apply, the contract is considered concluded at the occurrence of the first alternative. Failure to accept the offer within the specified timeframe is considered a rejection, releasing the Client from the offer.
2.4 If PayPal is the chosen payment method, the payment is processed by PayPal (Europe) S.à r.l. et Cie, S.C.A. The contract is accepted when the Client clicks the button to finalize the order process.
2.5 The contract text is stored by the Seller and sent to the Client in text form (e.g., email, fax, or letter) after order submission. The Client can access order data via a password-protected user account if created before the order.
2.6 Prior to finalizing the order, the Client can identify and correct input errors by carefully reviewing the displayed information. The browser's enlargement function may aid in recognizing errors. Corrections can be made before clicking the button to finalize the order.
2.7 The contract is exclusively available in English.
2.8 Order processing and communication occur via email and automated order processing. The Client is responsible for providing an accurate email address for order processing, especially when using SPAM filters.
3. Right to Withdraw
3.1 Consumers have the right to withdraw.
3.2 Details about the right to withdraw are provided in the Seller's cancellation instructions.
4. Pricing and Payment Terms
4.1 Unless otherwise stated, prices include statutory sales tax. Delivery costs, if applicable, are indicated separately.
4.2 Payment methods are listed in the Seller's online store.
4.3 For deliveries outside the EU, additional costs may arise, not the Seller's responsibility, borne by the Client (e.g., transfer fees, customs).
4.4 Prepayment by bank transfer requires immediate payment unless otherwise agreed.
4.5 If "PayPal invoice" is chosen, the Seller assigns the payment claim to PayPal. PayPal conducts a credit check; the Seller may refuse if the credit check is negative.
4.6 The contract is solely available in English.
4.7 Order processing and communication occur via email. The Client is responsible for an accurate email address to receive Seller communications.
5. Shipping and Delivery Terms
5.1 Delivery is made within the specified area to the address provided by the Client, as per the Seller's order processing.
5.2 If goods are returned due to non-delivery, the Client bears costs unless related to the right to withdraw or circumstances beyond the Client's control.
5.3 Personal collection is not feasible for logistical reasons.
5.4 Vouchers are delivered by email.
5.5 The Seller may withdraw from the contract in case of incorrect self-supply, making reasonable efforts to obtain the goods.
6. Retention of Ownership Rights
6.1 If advance deliveries are made, ownership remains with the Seller until full payment is received.
7. Product Warranty
7.1 Statutory defect liability applies unless otherwise specified.
7.2 If the Client is a trader: a) The Seller chooses the type of subsequent performance. b) The limitation period for new goods is one year from delivery. c) Rights and claims for defects are excluded for used goods. The limitation period does not restart for a replacement delivery under defect liability.
7.3 The above limitations do not apply to: a) Claims for damages and reimbursement of expenses. b) Fraudulent concealment of defects by the Seller. c) Goods used for building purposes causing their defect. Seller obligations for updates to digital products in supply contracts.
7.4 Statutory limitation periods for potential right of recourse for traders remain unaffected.
7.5 If the Client is a consumer, obvious transport damage must be reported to the courier immediately. Failure does not affect statutory or contractual defect claims.
8. Special Terms for Repair Services
If the Seller repairs a Client's item, the following applies:
8.1 Repairs occur at the Seller's place of business.
8.2 The Seller may use qualified personnel or third-party subcontractors for services unless specified otherwise.
8.3 The Client provides necessary information for repairs, and the item must be sent to the Seller at the Client's expense and risk unless otherwise agreed.
8.4 The Seller is liable for repair service defects under statutory liability for defects provisions.
9. Utilization of Promotional Vouchers
9.1 Free campaign vouchers issued by the Seller are redeemable only in the Seller's online store and within the specified timeframe.
9.2 Some products may be excluded from voucher campaigns as per campaign voucher conditions.
9.3 Only one campaign voucher is redeemable per order.
9.4 The voucher amount should meet or exceed the order value; no refunds are provided for remaining amounts.
9.5 If the voucher value is insufficient, the Client can use other payment methods to cover the difference.
9.6 Voucher credit is non-cash and non-interest-bearing.
9.7 The voucher is not redeemable if the Client returns goods paid wholly or partially with the voucher as part of the legal right to withdraw.
9.8 The voucher is transferable unless the Seller is aware of non-entitlement, legal incapacity, or lack of representation in a grossly negligent manner.
10. Utilization of Gift Vouchers
10.1 Gift vouchers purchased via the Seller’s online shop are redeemable only in the Seller’s online shop, unless otherwise specified.
10.2 Gift vouchers are valid for three years from the year of purchase. Remaining amounts are credited to the Client’s voucher account.
10.3 Gift vouchers can only be redeemed before completing the order process.
10.4 Only one gift voucher is redeemable per order.
10.5 Gift vouchers can only be used to purchase goods, not additional gift vouchers.
10.6 If the voucher value is insufficient, the Client can use other payment methods to cover the difference.
10.7 Voucher credit is non-cash and non-interest-bearing.
10.8 The voucher is transferable unless the Seller is aware of non-entitlement, legal incapacity, or lack of representation in a grossly negligent manner.
11. Governing Law
The laws of the Republic of Austria apply to all legal relationships between the parties, excluding international laws governing the purchase of movable goods. For consumers, this choice of law applies unless withdrawn by mandatory laws in the consumer's country of residence.
12. Jurisdictional Venue
If the Client is a business, public entity, or separate estate under public law in Austria, the Seller's place of business is the sole jurisdiction for all legal disputes. If the Client is outside Austria, the Seller's place of business is the sole jurisdiction if the contract or claims relate to the Client's professional or commercial activities. In all cases, the Seller may choose the court at the Client's seat.
13. Alternative Dispute Resolution
13.1 The EU Commission provides an ODR platform for out-of-court resolutions of disputes arising from online sales and service contracts between consumers and traders.
13.2 The Seller is neither obliged nor prepared to participate in alternative dispute resolution proceedings.
